NYC's Local Law 97: Building Owners' Most Frequently Asked Questions


With the extended deadline for filing LL97 reports fast approaching, many of our clients have questions about the report filing process.

Here, our experts have answered the most commonly asked questions from clients regarding LL97.  


What is Local Law 97? 


Local Law 97 (LL97) of 2019 places limits on carbon emissions for New York’s largest buildings starting in 2024, with the goal of reducing carbon emissions from the affected buildings at least 40% by 2030 and over 80% by 2050. 


What’s the best way to find out if my building is covered under LL97? 


Locate your property’s BIN#, or Building Identification Number, on DOB NOW. 


Search the Complete CBL (CY 2025) using the BIN#. 


How can I determine what ‘Covered Property’ (CP) classification my building falls under? 


There are 5 types of covered properties, each of which dictates how and when you must comply with LL97: 

  • CP0: Article 320 beginning 2024 

  • CP1: Article 320 beginning 2026

  • CP2: Article 320 beginning 2035

  • CP3: Article 321 One-Time Compliance 

  • CP4: City Portfolio Reductions

How do I file the annual compliance report? 


  1. Log into your DOB NOW account. Ensure any outstanding DOB property fees have been paid. Pay Local Law 97 filing fees. 

    1. Note: you will not be able to file for LL97 if you have outstanding DOB property fees. 

  2. Log into your ESPM account. Verify Energy Star data is inputted (synced with ConEd) and accurate. 

  3. Create a BEAM profile and add your RDP’s email address. The RDP will receive a notification that they have access to provide an attestation of the building data in BEAM.

Who can help me file my annual compliance report? 


LL97 requires building owners to work with a registered design professional (RDP) to calculate their building emissions and submit plans/documents to the DOB. 


Only professional engineers (PEs) and registered architects (RAs) are Registered Design Professionals.

How can I ensure my building’s energy usage is calculated in the most advantageous way? 


The best way to ensure your building’s energy usage is calculated accurately is by working with a registered design professional through a third party company, such as Maypole. 


Registered design professionals can calculate the gross floor area of your building(s) and upload your data into the reporting portal. 


What can I do if I didn’t meet the 5/1 filing deadline? 


The LL97 filing deadline has been extended from May 1, 2025 to June 30, 2025. 


If you believe you will not be able to file during this two-month grace period, you have until 6/30 to file for an extension. If your request for an extension is granted, you will have until August 29, 2025 to file.  


How can I mitigate penalty fees if my energy usage exceeds my LL97 limit? 


You must submit a mediated resolution or  proof that you’ve made a good faith effort to comply with the law to the DOB. Penalty mitigation is awarded on a discretionary basis.
